1. Agreement to Terms

By accessing or using https://familycalculator.com (the "Site"), you ("User," "you," or "your") agree to be legally bound by these Terms of Service ("Terms") and all policies incorporated herein by reference, including our Privacy Policy and Cookie Policy. If you do not agree to all of these Terms, you must immediately stop using the Site.

We reserve the right to modify these Terms at any time. Changes take effect when posted to the Site. We will update the "Last updated" date at the top of this page. Your continued use of the Site after any modification constitutes your acceptance of the updated Terms. If a modification materially affects your rights, we will make reasonable efforts to provide notice (e.g., a prominent notice on the Site). 2. Eligibility — Age Requirement

You must be at least 18 years of age to use this Site. By using the Site, you represent and warrant that you are 18 or older. This Site is not directed to, and we do not knowingly collect information from, persons under the age of 13. FamilyCalculator.com provides free, web-based child support calculators that estimate monthly child support obligations based on publicly available state guidelines. The Site covers calculators for Texas, California, Florida, New York, Georgia, Illinois, Ohio, and Pennsylvania.

The Site is intended for informational and educational purposes only. The Site is:

  • Not affiliated with any government agency, court, law firm, bar association, or official body
  • Not a licensed legal service provider in any jurisdiction
  • Not a substitute for professional legal, financial, or tax advice
  • Not subject to attorney ethics rules, legal privilege, or confidentiality obligations

Child support obligations are determined exclusively by courts of competent jurisdiction based on each family's specific facts and circumstances. The estimates produced by this Site:

  • Are approximations only, generated by simplified algorithmic models
  • May differ substantially — sometimes by hundreds of dollars per month — from an actual court order
  • Do not account for judicial discretion or court-ordered deviations from guidelines
  • Do not account for imputed income (income attributed to voluntarily unemployed or underemployed parents)
  • Do not reflect exact tax liability (federal and state tax estimates used by this tool are simplified)
  • Do not capture extraordinary medical expenses, special educational needs, or disability costs
  • Do not account for substantial timesharing adjustments in all states
  • Do not reflect the impact of existing bankruptcy proceedings, prior court orders, or agreements between parents
  • Are based on guideline formulas that may have changed since this tool was last updated
  • Should never be relied upon for any legal purpose

You must not present, cite, attach, or otherwise use the results of this calculator in any legal proceeding, court filing, mediation session, arbitration, or settlement negotiation. Calculator output is not admissible as evidence in any court of law.

5. Accuracy and Currency of Information

We make reasonable efforts to maintain accurate and up-to-date calculator formulas and guideline data. However, child support guidelines are subject to periodic legislative amendments, cost-of-living adjustments, and court rule changes that may occur at any time. We make no warranty, express or implied, that the information on this Site is:

6. Permitted Use and Restrictions

If you believe any content on this Site infringes your copyright, please send a written notice to info@familycalculator.com that includes: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the material on the Site and its location; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; and (e) a statement under penalty of perjury that the information is accurate. 10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAMILYCALCULATOR.COM, ITS OPERATORS, AFFILIATES, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, BUSINESS, REPUTATION, OR GOODWILL
  • PERSONAL OR BODILY INJURY OR PROPERTY DAMAGE OF ANY NATURE
  • DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS RESULTS
  • DAMAGES ARISING FROM ERRORS, INACCURACIES, OR OMISSIONS IN CALCULATOR RESULTS
  • DAMAGES ARISING FROM ANY LEGAL OR FINANCIAL DECISIONS MADE IN RELIANCE ON THE SITE
  • DAMAGES ARISING FROM CHILD SUPPORT ORDERS, LEGAL PROCEEDINGS, OR SETTLEMENTS IN WHICH THESE ESTIMATES WERE CONSIDERED
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA

WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM (WHICH IS $0.00 FOR THIS FREE SERVICE) OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

11. Indemnification

You agree to defend, indemnify, and hold harmless FamilyCalculator.com, its operators, officers, directors, employees, contractors, licensors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of or access to the Site
  • Your violation of any provision of these Terms
  • Your violation of any third-party right, including intellectual property rights or privacy rights
  • Any claim that content you submitted or shared using the Site caused damage to a third party
  • Any legal proceeding, dispute, or outcome in which you used or cited information from this Site

This indemnification obligation survives termination of these Terms and your use of the Site.

12. Dispute Resolution — Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

12.1 Informal Resolution First

Before initiating any formal dispute, you agree to contact us at info@familycalculator.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving your notice. If the dispute cannot be resolved informally within 30 days, either party may proceed to arbitration as described below.

12.2 Binding Arbitration

Except for claims described in Section 12.4 (Exceptions), all disputes, claims, or controversies arising out of or relating to these Terms, the Site, or your use of the Site shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12.3 Class Action Waiver

YOU AND FAMILYCALCULATOR.COM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. The arbitrator may not consolidate or join the claims of other persons or parties, and may not otherwise preside over any form of a consolidated, representative, or class proceeding.

12.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights, or to prevent irreparable harm.

12.5 Governing Law and Venue

These Terms and any dispute related thereto shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. To the extent any claim or dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

13. Termination

We reserve the right, in our sole discretion, to suspend or terminate your access to the Site, without notice and without liability, for any reason, including but not limited to: violation of these Terms, conduct that we believe is harmful to other users or to us, or any activity that may expose us to legal liability. All provisions of these Terms that by their nature should survive termination shall survive, including disclaimers, limitations of liability, indemnification, and dispute resolution provisions.

14. Privacy

Your use of the Site is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the data practices described in the Privacy Policy.

15. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms arising from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, riots, government actions, power failures, internet outages, or third-party service failures.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed, and the remaining provisions shall continue in full force and effect.

17. Waiver

No failure or delay by us in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. A waiver by us of any default shall not be construed as a waiver of any subsequent default of the same or any other provision.

18. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and FamilyCalculator.com with respect to your use of the Site and supersede all prior and contemporaneous agreements, understandings, representations, and warranties, whether written or oral, relating to the Site.
